Thank you for  visiting Cigar Kingdom ( “CKC”, “Website” , “Seller”,  “We” or “ Us)  and using our service (“Services”) Please note: by accessing this website or using our service,  you indicate that you have read, understood and agreed to be bound by our terms of service and must follow any policies made available to you within the service.

CKC reserves the rights to modify the Website and terms at its sole discretion. Should you be in objection to such terms and conditions, you must terminate use of Services immediately. For any other queries, please contact our Customer Service Support for more information.

This notice is originally written in Chinese and may be translated into other languages. If there is any discrepancy between the traditional Chinese version of this notice and other translations, the traditional Chinese version shall prevail.

 

Terms of Service

Thank you for visiting www.cigar-kingdom.com Cigar Kingdom Limited (“CKC”) website.

You must meet the legal age and legal requirements stipulated by the laws of the country where you are located before you can register as a member, use or continue to use the terms of service. When a member uses or continues to use CKC, it is presumed that you have read, understood and agreed to accept all the contents of the terms of service and subsequent revisions, and fully accept the existing and future derivative service items and contents of the service.

 

Privacy Policy

CKC committed to protect your personal information. Without your consent, your name, email address , or any personal information will not be sold, rented or sent to a third party. We may collect , use , store and disclose any personal data you provide in accordance with privacy policy

 

Eligibility to Purchase

You must be compliant with the condition belo in order to complete purchases at CKC;

  • You must meet the legal age and legal requirements of the country or region where you are located
  • We are not responsible or liable for any misrepresentation of age that purchase or browses at CKC
  • Provide valid and accurate personal and payment details (including but not limited to mailing address, real name, telephone number, billing information, and other required information stated on the website).

 

Tax and Duties

Taxes and duties applicable to your order depend on the shipping country of your order. You are responsible for payment of the import tax and duties levied by the country to which the products are shipped. Payment of such tax and duties and necessary for the release of the products.

 

Shipping

All orders will be shipped within 72 hours and it will be delivered within 15 – 30 working days depending on the country and region.

 

Order Returns

Due to the particularity of cigars, returned items can only be reshipped , and cannot be refunded or exchanged. All fees incurred from the return shipment shall be paid in full by the customer. Should the parcel be required to be re-shipped, the customer is responsible for all delivery charges for the second shipment; which is USD 35/ parcel, USD 70/parcels and so forth.

After we receive the returned items, we will arrange the reshipment followed by email notification and payment link for the reshipment fee. Reshipment will be made within  two working days after completing the payment.

 

Delivery

Delivery date should be estimated to be delivered within the time specified by the seller with reasonable endeavours. The seller should not be liable for any additional cost, losses or damages.

 

Limitation of Liability for Claims

Buyer acknowledges and agrees that seller’s liability for any claim for the products shall not exceed the amount paid by buyer for the product under the invoice. This limitation applies to the seller’s liability for claims even if the liability for the claim is wholly or partly due to the seller’s own negligence.

 

Intellectual Property

All CKC software and content (including text, audio or music, video, graphics, photos, and images) belong to CKC and are protected under intellectual property and copyright laws, and international treaty provisions.

The Website is for your personal and non-commercial use only. Any other use of the materials, non-personal or commercial, must be officially authorised by CKC  and/or its third-party licensors. You are prohibited to distribute, reproduce, publish, sell or licence any existing content on the Website without prior authorisation from CKC.  Any found misuse can and may result in civil consequences and criminal penalties.

CKC  reserves the right to withdraw or amend any item of the Services without notice and will not be liable for any reason if the Website should not be not available at any time and at any period.

 

Responsibility Disclaimer

On some occasions, the Website may display content or resources that are not under possession of CKC. In such cases, the Website bears no control over such content and is not liable for any loss or damage caused by your connection of use with them.

Comments or publications made by other third parties do not represent or reflect CKC and are their own personal opinions. CKC is not liable for such content. Under no circumstances should CKC warrant error-free and virus-free content on the Website and the Services. We strongly recommended installing the latest anti-virus software when using the Services. CKC takes no responsibility for any loss caused due to unforeseeable circumstances, including bad weather. However, CKC will be willing to offer full assistance in such cases.

The use of the external websites will be at your own risk and subject to the Terms of Use and Service contained within each of such sites.

 

Your Rights

These Terms of Service are not intended to affect your rights under the laws in Hong Kong Special Administrative Region.

CKC has set up a complaint handling procedure to resolve any dispute that arises. For any other queries, please contact our Customer Service Support for more information.

 

Governing Law and Jurisdiction

The Terms of Services, together with all policies and procedures, are governed by and construed in accordance with the Hong Kong Special Administrative Region law. The relevant courts of Hong Kong Special Administrative Region will have exclusive jurisdiction in the event of any dispute or claim associated with these Terms of Services.

私隱權

CKC 承諾保障您的私隱。沒有您的同意不會將您的名字、電郵地址、或任何個人資料售賣、出租或發送予第三者。

我們可根據私隱政策收集、使用、儲存及披露您提供的任何個人資料。

 

購買資格

您必須符合我們的下述資格條件才能購買：

  • 您須已符合於所在地國家或地區法定年齡和法律要求。
  • 我們並不對任何瞞報真實年齡購買或瀏覽者負責或承擔任何責任。
  • 提供個人及付款詳情，而且保證其有效及準確（包括但不限於郵寄地址、實名、電話號碼、帳單資料，以及網站載明的其他所需資料）。

 

關稅

如運送到其他國家，產品尚未繳納關稅，因此客戶需自行處理所在國家的關稅。

 

運送詳情

所有訂單會在72小時內發貨,快遞服務大概15 – 30 工作天便可以收到貨品。

 

通關檢查或稅款導致的退運

由於雪茄的特殊性，退運的貨品只能辦理重寄不能退貨及換貨，退運所產生的任何費用將由會員自行承擔。

我們在收到您的退件後會以退运邮包重寄安排, 電郵通知，隨其附上重寄費的付款連結，請在付款完成後的兩個工作日以您收到的電郵回覆重寄相關信息；而我們會依照您的回覆，以商品原盒的原包裹安排重新寄送。

 

控制條款

買方明確同意賣方的發票和本銷售條款及條件代表雙方就發票上列出所銷售的產品已達成完整的協議，以及在買方的購買訂單上沒有不同或附加的條款或條件或在任何其他先前或之後的通訊中以任何方式添加、修改，否則，賣方有權更改本銷售條款及條件細則。

 

運送貨品

賣方的管理層應以書面簽署協議，所有交貨日期應以賣方在合理盡力的情況下估算於指定時間內送達所有貨品；然而，不論在任何情況下，因賣方未能於指定日期內送達貨品而令買方遭受任何額外的費用、損失或損害，賣方都不會負上任何責任。

 

索賠責任限制

買方承認並同意賣方對產品的任何索賠責任不得超過買方為發票下的產品所支付的金額。 即使索賠責任全部或部分是由於賣方自身的疏忽引起，賣方的索賠責任也適用於這限制下。 買方或其繼承人或受讓人若採取的任何行動推翻本議案，必須在產生訴訟事由後一年內開始。

 

保障

買方應就賣方及其附屬或相關公司的任何和所有索賠、損失、責任、損害賠償和費用支出提供抗辯，賠償和保護，包括但不限於律師費用和防禦成本，關於或以任何方式與任何由於買方在賣方同意或未經買方同意或任何不當處理或存儲，違反任何條款或條件而對其進行的任何更改或修改所導致的任何所聲稱的產品缺陷或產品瑕疵，買方未能標記產品或買方不當的產品標籤，無論標籤是否在賣方的建議下進行，或買方的任何行為或不作為，包括任何人身傷害的索賠（包括死亡）或財產損失或經濟損失，若干或相對疏忽，違反協議，違反保證或其他違約責任或受償方的責任或因受償方的嚴格或其他產品責任。上述賠償不得解釋為消除或以任何方式減少受償方根據法律規定的任何其他賠償或權利。

 

知識產權

CKC所有的軟體和內容（內容的定義為，或包括，任何文字、音訊或音樂、視頻、圖表、照片和圖像）均為我們的知識產權，並受知識產權和版權法律及國際條約規定的保護。

網站僅供您個人以非商業目的使用。只有在經我們及/或其第三方許可人明確授權的情況下，才可將內容用於任何非個人和/或商業用途。您不得在未經我們事先同意或授權的情況下，轉發、複製、公佈、出售或許可使用任何載於網站的內容。該等未經授權的行動可能導致民事後果或刑事處罰。我們保留不經通知即撤回或修訂任何服務項目的權利。如果因任何原因網站於任何時候及在任何期間無法訪問，我們不承擔任何責任。
